The Sales Contract

The document you sign to present your formal offer to the buyer includes the price, terms and conditions of the sale. Once accepted and signed by the seller, it becomes the sales contract and is fully binding. Make sure you dont forget anything important because its almost impossible to put it in after the signatures are attached. Here are several items that may be included or negotiated on as part of the offer/contract:

  • Sale Price
  • Household items or furnishings which may or may not be included in the sale such as appliances, lighting fixtures, swimming pool (not built-in), other personal property.
  • Earnest money deposit
  • Amount of down payment
  • Mortgage amount
  • Date, time, and place of settlement
  • Date of occupancy
  • Contingencies such as:
    • required improvements and inspections
    • proof of clear title
    • sale of your current home (if applicable)
    • your ability to obtain acceptable financing
    • legal review by buyers/sellers attorney
  • Signatures of both buyer and seller (You may withdraw your offer up until the seller has accepted and signed the offer.
